On Wednesday, a federal judge dismissed Hunter Biden's attempt to stop the prosecution of his Delaware gun case, calling it unsubstantiated and "frivolous."
U.S. District Judge Maryellen Noreika made the decision, turning down Biden's plea to halt the investigation conducted by Special Counsel David Weiss.
Biden argued that Weiss's appointment breached the Appropriations Clause, asserting that Weiss lacked the status of an "independent counsel" and lacked Congressional approval.
"In his motion filed on May 14, Mr. Biden urged the Court to either halt the Special Counsel's investigation and prosecution of him until Congress appropriates funds or promptly deny the motion for appeal.
However, the judge dismissed Biden's arguments, affirming that using permanent appropriations to finance special counsels is firmly established and has been upheld in the past.
Judge Noreika stated in her decision that Mr. Weiss's appointment was lawful under relevant statutes. She emphasized that he was appointed as a special counsel to oversee investigations and prosecutions in this criminal case, qualifying as an 'independent counsel' appointed under 'other law' within the scope of permanent appropriation."
